Speth case against Ole Miss to reopen?

Folks may recall a few posts over on Folo about Professor Speth’s case against the University of Mississippi.  Not long after the issue was joined, the case quietly settled.  The Tupelo Journal reported today that the parties have moved to reopen the case because they are having trouble with the terms of the settlement.  The motion (filed by the plaintiff’s lawyer, but stating it is on behalf of all parties) says that, since settling, “some issues concerning the interpretation of, and compliance with, the terms of said [settlement] agreement have arisen that could not be resolved by agreement of the parties and that require adjudication by the Magistrate Judge.”

On April 16, Judge Sharion Aycock dismissed the case of Dr. Robert C. Speth because a settlement was in the works.

However, by Monday, attorneys for Speth and for Ole Miss asked the federal court to reopen the case.

They said issues, which they cannot resolve, have arisen about their agreement.

In December, the university and eight of its officials were sued by the former chair of the Department of Pharmacology, who alleged he was fired because he blew the whistle on improper use of grant funds.

He also wanted his chairmanship back, back pay and replacement of funds from his research account.

Speth, who describes himself as a prominent researcher in a cause of high blood pressure, accused the university and the officials of setting out to humiliate and fire him after he reported misuse of research funds.
