I highly recommend the discussion beginning here on Slate between Dahlia Lithwick, Emily Bazelon, Walter Dellinger, and Linda Greenhouse about the Ricci case. It’s excellent, explaining that the case may be a sea-change in Title VII, weakening disparate impact theory.
