This week’s Court of Appeals decision list has five decisions, two of them in criminal cases and three in civil cases.
As in last week’s round (the May 5th COA Decisions List), we’re asking folks to read a decision and say something about it in comments. Last week, two cases drew comments. Later, I noted that former Justice Oliver Diaz was posting criminal case summaries for the state office of indigent defense appeals, and those would be available a few days after the decisions. This morning, in the comment thread for last week, I linked his summary for that list (which demonstrated that no other criminal case was worthy of comment than the one I randomly picked to note).

Not much to comment on in this list, NMC. The adverse possession case is a good example of the need to do a thorough elements-to-evidence tree for any hearing.

Eugene C. Frazier, et al v. Simon Frazier. et al 2008-00555. Plaintiff went in with essentially no opposition but did not produce evidence on each of the statutory elements. I’ll attempt an actual link the next time I post on one of these cases.
